Terms of Service

These Terms of Service govern the relationship between "BulGhar Homes" EOOD, Company ID (EIK) 208397562, registered address Varna, 20 Chataldzha Str., entr. A, apt. 7, represented by manager Raffy Nikoghosyan (hereinafter "BulGhar Homes", "we" or "the Company"), and persons who use the website bulgharhomes.com and its client portal. By using the site, you accept these Terms of Service. If you do not agree with them, please do not use the site.

1. Scope
These Terms apply to the use of the website bulgharhomes.com, including the property listings, blog content and contact forms published on it, as well as to the BulGhar Homes client portal, through which clients track the status of their deals, exchange documents and messages, and view scheduled viewings. Terms for specific brokerage services are governed separately by an individual agreement, which takes precedence over these Terms in the event of a conflict.
2. Services
BulGhar Homes provides brokerage services for the purchase, sale and lease of real estate, including consultations, arranging viewings, assistance with negotiations and preparation of transactions. Terms for specific transactions, including the scope of services, timelines and fees, are governed by an individual brokerage agreement between BulGhar Homes and the respective client. Publishing information on the site does not create an obligation for the Company to provide a service without such an agreement in place.
3. Property Information
Property listings published on the site are for informational purposes only and do not constitute a binding offer within the meaning of the Bulgarian Obligations and Contracts Act. Listed prices, areas, features and availability are subject to confirmation and may change without notice. BulGhar Homes makes efforts to keep the information accurate and current but does not guarantee its completeness. The final terms of each transaction are settled during negotiations and reflected in the relevant contracts.
4. Client Portal
Client portal accounts are created by BulGhar Homes for clients with a signed brokerage agreement, or in the process of signing one. The user must keep their password confidential and must not share it with third parties. Any action taken through the account is considered to have been taken by its holder, unless the user has promptly notified us of unauthorized access.
Any misuse of the portal is prohibited, including attempts to gain unauthorized access to other accounts or data, breaching the security of the system, uploading malicious code, or using the portal for purposes other than intended. In the event of a violation, BulGhar Homes has the right to restrict or terminate the user's access and, if necessary, refer the matter to the competent authorities.
5. Fees
Use of the site and client portal is free. BulGhar Homes' fee for brokerage services (commission) is agreed in the individual brokerage agreement with each client, including its amount, the conditions under which it becomes due, and the method of payment. The site does not contain binding pricing terms for brokerage services.
6. Intellectual Property
The content of the site, including text, photos, logo, graphic layout, design and program code, is the property of "BulGhar Homes" EOOD or is used with the permission of the relevant rights holders, and is protected by the Copyright and Related Rights Act. Copying, reproducing, distributing or using the content for commercial purposes without the Company's prior written consent is prohibited. Viewing and printing materials from the site is permitted solely for personal, non-commercial use.
7. Limitation of Liability
BulGhar Homes is not liable for damages arising from inability to access the site or portal, technical interruptions, actions of third parties, or circumstances beyond our control. The Company is not responsible for the content of external sites that the site may link to. Information on the site does not constitute legal, tax or investment advice; for specific transactions we recommend consulting the relevant specialists. Nothing in these Terms limits the Company's liability in cases where it cannot be limited by law, including liability to consumers under the Consumer Protection Act.
8. Personal Data
The processing of personal data in connection with the use of the site, the client portal and our brokerage services is described in our Privacy Policy, which forms an integral part of our relationship with users. Please review it before using the site.
9. Governing Law and Dispute Resolution
These Terms and the relationship between BulGhar Homes and users are governed by Bulgarian law. All disputes are resolved through negotiation, and if agreement cannot be reached, by the competent Bulgarian court.
Consumers within the meaning of the Consumer Protection Act may also turn to the Consumer Protection Commission (CPC), 4A Slaveykov Sq., Sofia, Bulgaria, website: kzp.bg. Disputes may also be referred to the conciliation commissions at the CPC.
10. Changes to These Terms
BulGhar Homes reserves the right to amend these Terms in the event of changes to our business, services, or applicable law. The current version is published on this page together with its effective date. Continued use of the site after publication of amendments is deemed acceptance of them. For clients with active agreements, material changes are communicated in an appropriate manner, including through the client portal or by email.
